GENERAL CONDITIONS OF SALE
AZUR PARAGLIDING
ART. 1. PURPOSE
These general terms and conditions of sale apply to all services and products offered on the azur-parapente.fr website. Their purpose is to define the terms and conditions under which Thierry DELORME Azur Parapente offers its products and services to customers. They come into force as soon as an order is validated on our website or directly via our secretariat.
Documents concerning products and services, such as descriptions, technical sheets, photos, or other information, are provided for information purposes only and are respected as far as possible. This is particularly true for aerial leisure activities that depend on external conditions, which only the pilot can interpret. It may happen that the service is cancelled at the time of departure (rare case) due to dangerous or inappropriate practice conditions, due to a sudden change in natural parameters.
These general terms and conditions of sale govern our relations with our customers and take precedence over any other stipulation emanating from the customer. The simple fact of the customer placing an order constitutes definitive and irrevocable consent to these conditions.
ART. 2. VALIDITY OF THE OFFER
Our offers are subject to availability at the time of registration if a fixed date is agreed. For a reservation by "gift voucher", a validity deadline of "one year" after the date of purchase is always mentioned on this voucher. The service must be carried out during this validity period, during our operating season, i.e. from October to the end of April. We advise you to validate a date as early as possible, at least one month before the expiry of the validity of the "gift voucher".
Any activity interrupted, shortened or not consumed by the beneficiary for any reason will not give rise to any reimbursement.
Except for the cases provided for in these general conditions of sale, no unilateral cancellation of an order is possible without the seller's agreement. For appointments not canceled 48 hours in advance, the services ordered remain due to Azur Parapente, and no refund will be granted.
Aerial activities, including paragliding, depend on the weather and aerology. Azur Parapente indicates on its online sales site the most favorable periods of the year for performing free flight services. It is therefore essential to take these periods into account when making an appointment. The customer is responsible for making an appointment. Azur Parapente cannot be held responsible for making an appointment late in relation to the end of validity of the order, resulting in the impossibility of carrying out the service for unfavorable aerological reasons.
ART. 3. FORMATION OF THE CONTRACT
Identification of the parties:
Any order placed by a Customer via azur-parapente.fr commits the Customer upon payment of the order. After ordering online, the customer will receive an acknowledgement of receipt by email confirming the registration of the order by the reservation center, as well as the gift voucher in PDF format. Any order implies acceptance of these general conditions that the customer acknowledges having consulted.
The content of the azur-parapente.fr site allows the customer to know precisely the essential characteristics of the service he wishes to order before concluding the contract.
ART. 4. ORDERING ON THE SITE www.azur-parapente.fr
The customer can place their reservation order either by telephone by calling: 06 80 13 59 15, or directly on the azur-parapente.fr website.
Our offers are valid for one year, unless a specific date is chosen. This flexibility allows the Beneficiary to call us later to propose practice dates. If the Client wishes to carry out one of our activities on a specific date, it is advisable to call us in advance to check our availability.
ART. 5. SERVICES OFFERED

ART. 6. PRICE AND PAYMENT TERMS
Orders placed by the customer via the website www.azur-parapente.fr and other domains belonging to Thierry DELORME are binding on the customer as soon as they are validated by clicking on the "Book" button.
The customer is subject to the T&Cs of the YoPlanning reservation platform from the time of reservation.
After placing the order online, the customer will receive an acknowledgement of receipt by email confirming the registration of the order by the azur-parapente.fr website via the YoPlanning platform.
YoPlanning issues the customer a payment certificate related to the purchase of the activity. As the service provider of the activity, Thierry DELORME may provide an invoice to the customer upon request, stating "payment received".
Any order implies acceptance of these general conditions which the customer acknowledges having consulted.
The prices, indicated in Euros and per person (unless otherwise stated on each product sheet), are those in effect at the time of consultation by the Customer.
The Customer has several means of payment. Payment can be made:
An invoice from the company Azur Parapente or "on behalf of the service provider", depending on the formula chosen, will be issued upon simple request from you. Azur Parapente cannot be held responsible in the event of non-processing of an order due to invalidation of payment. The service may be collected on behalf of a service provider.
ART. 7. CONDITIONS OF USE OF A VOUCHER (ORDER, GIFT VOUCHER)
Any holder (buyer) of a purchase order or gift voucher has proof of payment with Azur Parapente, allowing them to carry out the activities we offer. These vouchers are not nominative and specify the service and the formula chosen.
Procedure to follow: 8 days minimum before the date scheduled for the service: The Client or Beneficiary must imperatively contact Azur Parapente to validate a reservation date. This procedure must be carried out at least 8 days before the desired date. Depending on the season, we cannot guarantee immediate availability for our activities or service providers, so it is preferable to anticipate your validations.
After confirming a date for the meeting, we will tell you the location and time of the meeting.
The day before your appointment:
We will contact you by phone to confirm the time of your appointment and answer your last questions. In case of bad weather, we will reschedule the flight to another time. We do this one day before the flight date or the evening before from 6:00 p.m., after having taken all the weather forecasts necessary for the successful completion of your activity.
D-Day: You must arrive on the scheduled day at the activity location, 13 Avenue le Corbusier, 06190 Roquebrune Cap Martin, 15 minutes before the meeting time. Don't forget to wear clothing appropriate to the activity or the season (provided when contacting the service provider) and to bring the booking voucher that you must give to the service provider. Please note that the possibility of a last-minute cancellation is one of the constraints related to air activities.
ART. 8. CONDITIONS FOR CARRYING OUT THE ACTIVITY
All customers are informed that the course of aerial activities may be subject to changes due to poor weather, aerological or material conditions that may affect safety, or for reasons beyond the control of the service provider, such as a modification, restriction or ban on airspace. The beneficiary or customer will be informed, as far as possible, by Azur Parapente of these possible changes.
The schedules of our activities and flight times are given for information purposes only and we strive to respect them. However, if we or one of our service providers were to modify them for safety or aerodynamic reasons, no recourse may be made by the beneficiary or customer.
Aviation activity is a "risky" environment that pilots and instructors strive to minimize through their experience, professionalism and the material resources implemented. However, it is obvious that they cannot guarantee 100% safety due to the risks inherent in this environment.
The beneficiary or client also agrees not to exercise any recourse under civil or criminal liability and to only make any complaints regarding the progress of the activity directly to the service provider (or independent instructor) whose contact details are displayed on the Azur Parapente vehicle, as well as those of its insurers.
ART. 9. POSTPONEMENT, CANCELLATION OR MODIFICATION OF A RESERVATION
All services offered by azur-parapente.fr are valid for one year. In the event of an impediment, the client may benefit from a postponement, or a change of name of the beneficiary. No refund will be granted.
Any person who does not show up on the agreed day and time automatically loses the validity of their voucher.
In the case of a reservation by email or telephone, without a deposit from you at the latest two weeks before the appointment, we will cancel the reservation.
Special case:
1st Case: Cancellation on our part: In case of bad weather, we reschedule the flight with the future passenger at another time. (It is important to give us your telephone number). We do this one day before the flight date or the evening before. For any other reason beyond our control, we try to reschedule the paragliding flight.
2nd case: Cancellation on your part:
The appointment is set two days before the flight, and you will receive an email. The full payment will be forfeited. Before these two days, you will have the opportunity to cancel or reschedule.
ART. 10. ASSURANCES
Insurance from service providers or third-party companies.
The customer is informed that the service providers chosen by azur-parapente.fr all hold professional civil liability for sufficient amounts and have all the authorizations or diplomas necessary to carry out their activities.
Additional insurance.
It is up to the customer or beneficiary who considers that the level of guarantees offered by the service provider, with regard to the activity carried out and their personal social protection, is insufficient, to take out additional guarantees (art 37 and 38-L84-610 of the insurance code – obligation to provide information).
ART. 11. INTELLECTUAL PROPERTY
All logos, brands, designs and models present on the Azur Parapente website are the property of Mr. Thierry DELORME. Any partial or total reproduction, regardless of the medium, for commercial, associative or voluntary purposes, is prohibited without the consent of the holders of the brands or rights attached to these graphic representations.
ART. 12. CLAIMS
Any complaint relating to an activity must be sent directly to Azur Parapente, 228 Avenue Gustave Charpentier, 83370 St Aygulf, by registered letter with acknowledgment of receipt, within a mandatory period of 15 days after the return date, accompanied by supporting documents. After this period, no complaint will be taken into consideration.
ART. 13. MEDIATION
In the event of a dispute between the Customer and the company, the Customer will send a written complaint to the professional, who will endeavour to resolve it amicably. In the absence of an amicable agreement or in the absence of a response from the professional within a reasonable period of one (1) month, the consumer Customer within the meaning of Article L.133-4 of the Consumer Code has the possibility of contacting, free of charge, if a disagreement persists, the competent mediator registered on the list of mediators established by the Consumer Mediation Evaluation and Control Commission pursuant to Article L.615-1 of the Consumer Code, namely:

ART. 14. COMPUTING
In accordance with Law No. 78-17 of January 6, 1978, the requested information is necessary to process your registration. Your answers are mandatory, and their absence makes registration impossible. For any correction concerning the information transmitted during your reservation, please contact Azur Parapente directly. Unless you advise us otherwise, we reserve the right to use your contact details to send you, by email in particular, various information. Any violation of the provisions of this law is provided for and punishable by articles 226-16 to 226-24 of the Penal Code.
ART. 15. DISPUTE RESOLUTION – APPLICABLE LAW
Disputes arising from the use of the azur-parapente.fr sales site will be subject to the jurisdiction of the courts. These general conditions are subject to French law.
All Azur Parapente instructors are members of the FFVL charter for free flight instructors. This commits us to respecting the rules set out by the French Free Flight Federation.
